Read the guidance for mandatory life sentences for murder
The first line clearly states, The only offence for which a "life sentence", as defined by section 277 Criminal Justice Act 2003, is "fixed by law" is murder.
I have already stated that I acknowledge there are circumstances where the judge can set a time scale, but for murder the judge still hands down a life sentence.
That is mandatory. It is still a life sentence.
My point remains, if you get found guilty of murder, you get life as it is a mandatory sentence.
If you get a minimum tariff it does not always follow that the offender is released at the conclusion of that time period.
And yes I have read about the case. But none of us here have been subject to all of the evidence presented at court or since. And he has not had his conviction quashed.
So he is still a convicted rapist.

the minimum sentence for murder is not life imprisonment.
You get a life sentence for murder, but that does not mean imprisonment for life.
The prison sentence can vary depending on the seriousness of the murder though.
We were discussing whether or not there were variations on crime. You said there is no variation to murder.
You are now saying there is a variation on the tariiff.
So there is a variation on murder.
What is the point in this conversation?
You are deciding to stick to a technicality. Rather than just say yeah. Someone can get 30 years improvement for murder and someone else could get 120years. So yes there are variations to the crime

I have woken up naked in a bed next to a lass and not remembered what the hell happened a couple of times.
I had no recollection of giving consent. But I certainly didn't assume rape.

You may see that as a technicality.
I have said all along that the term of imprisonment handed down by the judge can be affected by mitigating or aggravating circumstances. But he will still give a life sentence.

You are the one that is changing the goalposts.
Your initial comment that I picked up on was that manslaughter was a lesser degree of murder. It isn't. They are two separate distinct offences.

I don't see what her drunk state has to do with anything. She didn't go back to a hotel with him. The other footballer wasn't convicted because she did go back with him.
She didn't know Evans. His mate text her to say he had a girl, so Evans let himself into the room.
Put yourself in that situation for that girl? You went back with one guy, and then a stranger enters the room whilst you've having se.x...
This case seems black and white to me.
A lot of this comes down to victim blaming. People thinking its her fault for getting really drunk and that girls shouldn't be sleeping with guys they don't know.

And who are you? A judge? A QC? Legal expert? Have you even been privy to all the evidence presented?
There clearly was evidence, which is why he was convicted in the first place and the verdict subsequently upheld in two appeals.
