Its a hate crime under the protected characters in law...

if the victim feels its a crime it will be dealt with as such, nobody here was at the scene so nobody knows what happened. Until we know otherwise it will be treated as a hate crime (under the racial part of that offence)

Apparently, it wasn't the woman being 'abused' who made the complaint but a third party who overheard the exchange.
