Trump’s line of defence on removing classified documents revealed:

‘On Friday night, Mr Trump's office issued a statement maintaining that he had used his authority while president to declassify the documents.

"He had a standing order that documents removed from the Oval Office and taken into the residence were deemed to be declassified," the statement said.

"The power to classify and declassify documents rests solely with the President of the United States.

"The idea that some paper-pushing bureaucrat, with classification authority delegated by the president, needs to approve of declassification is absurd."’

So basically, they’re going to argue that as Pres has the power to declassify documents, and that as only declassified documents can be removed, it can be assumed that any document that has been removed by Pres has, by default, been declassified

The reality:

‘"Presidents can declassify information but they have to follow a procedure," Tom Dupree, a lawyer who previously worked in the justice department, told the BBC.

"They have to fill out forms. They have to give certain authorisations. They can't simply say these documents are declassified. They have to follow a process [and it is] not clear that was followed here."’

Side note: Whilst Trump was in office, he actually strengthened the penalties for those found to have misused/misappropriated classified documents…

Is that basically not the Nixon defence of "it's not illegal if the President does it"?

Cause I'm pretty sure even the President can't, or shouldn't, be able to declassify nuclear documents

It doesn’t look good for him at face value. He’s clearly at the very least failed to follow protocols around the handling of classified materials correctly.
