He was flying in thick fog. The local emergency flying services were grounded at the time due to the conditions

You don’t say the point being the emergency services wouldn’t ground their helicopters unless the conditions were dangerous.

Not disagreeing with that but the point is whether it was legal to use a helicopter in those conditions - and was the pilot experienced enough to do so...?

its not illegal to drive in fog and it wouldnt be illegal to fly in it.
