People DO change though. Even the Mourinho from the end of his stint at Utd was a huge change from how he'd been earlier in his career.

You have no idea whether there is a clause or not though. You're just guessing.

With Spurs' current position you can't be sure that Spurs didn't just hire Mourinho regardless of the costs and that no such clause exists
