I don't know the law in that respect Germany, but perhaps he could have? I'm sure others more versed can answer that better.

Hope you're keeping safe and well with what's going on over there right now with the weather. Tragic for a beautiful piece of the world.

I read a lot of mental gymnastics on here and to see the excusing of someone that an independent tribunal has judged on is quite bizarre.

If there were no case to answer, it wouldn't;t have gotten to this.

If the evidence from Kiko had been consistent it wouldn't have gotten to this.

Clearly still a long way to go in taking racism seriously.

At the moment everything is fine where I am, we've had rain but not as bad as the West & South parts off Germany, Luxembourg, Belgium, Holland and a few others are getting hammered as well, but the weather says things should start easing over the weekend!..

Than maybe we'll see the true toll off what has happened!..

Jonty, a lot off people do take racism seriously, but the way this case was conducted and 2 mates v 1 person isn't the best evidence!..

I'll say something now about me and trouble I've had while being here!..

My German isn't the best and I've been here sinse 82, I'm the first to say to anyone that my German is crap and yes, I have an accent to mix it a bit more, but, when I was first learning the language I had trouble because I'd say what I thought was right only to be corrected and found what I'd said was rather insulting!..

It happened a lot!..

Sometimes what I've said in English it isn't a problem, but translated to German it has a complete different meaning, and that got me in trouble on more than one occasion!..

Maybe Kiko said something in the heat off the moment from Spanish to English and it came out the wrong way, it was suggested at the time he didn't know what he said was wrong!..

But it could also be argued that evidence against him was a lie!..

I do know there were others there but they were called liars, odd because some off them were mates off Kiko!..

Kiko should have refused the charge and seen where it would have ended!..

Jonty, you say your Wife is German, ask here how often she got things wrong while learning English!..

Unless she learnt at a very early age she will have made mistakes!..

Germany, its clear you haven't read the FA document, inconsistencies in Kiko evidence are key.

I didn't mention the Kiko case in the original post, but some thought it worth mentioning and excusing the situation.

Now to be clear, not saying that anyone on this thread is racist, but I hear these sorts of excuses all the time and they allow bigotry to flourish I'm afraid.

Jonty, let’s be honest and consistent here: the FA is really in no position to be speaking about inconsistencies, is it? You yourself have previously highlighted this with regards to hearings involving Leeds United Football club.

To maturely state a fact: at various points over the years past you and I have both been accused, on a variety topics, of being inconsistent, simply because we haven’t adhered to the mainstream consensus at the time.

Both of us would take issue with such an accusation of inconsistency, but I’m honest enough to say that likewise you have been proven to have a good record with presenting the facts over the years.

However, labelling anyone’s testimony as being inconsistent will ultimately remain the preserve of individual subjective interpretíon.

Do we have access to the transcript of the hearing? That way we can be sure to satisfy ourselves that there were no rhetorical questions, or attempts to coerce an admission of guilt (common practice) and in addition that the questions themselves were not also inconsistent relative to the somewhat sketchy testimonies which were presented in the first place. Are we able to draw a conclusion for ourselves as to whether there were inconsistencies, or are we left to accept the subjective interpretation of the authorities?

For many, the strong impression is given is that there was a clear agenda at the hearing which in fact was entered with a predetermined conclusion.

In reality, there is very little any individual can do to prevent any panel from going through the motions only, with little intention other than to give the appearance of giving a fair hearing.

Stripped away, there is nothing preventing any individual accusing another individual of being a racist. What must be made clear is that such accusations remain subjective, and that majority populist consensus is by no means proof of its accuracy,

Exactly….and it probably was.

Few of the above will have experienced being falsely accused. It makes little difference when ultimately found innocent; the damage is done.

The FA are the Pontius Pilate of football. The wash their hands and deliver a verdict to satisfy the baying woke crowd.

Kiko has all my sympthies; as a victim of lies, my eyes are fully open to the glaring inconsistencies of the FA and the way they handled the entire process.

Guilty until found innocent seems to be the way certain people on this forum think these matters should be handled.

Disgusting.
