If we take the assumption that Suarez said Negro at the time when the ref called the two over or there abouts, the time Suarez admitted but said it was in a different context then there isn't a lot to appeal as it is always down to probability and the defence will be "he wasn't being friendly" therfore he must of been being racist - I don't necessarily agree with this but I think it'd be hard to contest.

However the bit in the goalmouth is now taken as fact, the phrases "I kicked you because you are black" "I don't talk to blacks" and "Blackie, Blackie, Blackie" are all attributed to Suarez on Evra's say so - it could be exactly as Evra said, it could be as Suarez said but it could be about a million other combination of words too.

Suarez would still have been in trouble had he been found guilty of the offence when he claimed Evra called him "South American" but this whole goalmouth incident paints him in the worst possible light, why couldn't the FA have said "we find Luis guilty as he admitted saying negro but contradicted himself upon his intention" then said something like "there was an accusation about what was said in the goalmouth but that is unproven due to no evidence"?
