Thats not what will happen here. The players have left, they will find new clubs.
Only question will be if their new club will be later made to pay compensation. Or if they have to pay it out of their own pocket.

Not trying to prove anything, other than the area isnt quite as cut and dry as the media are making out.
I think he will probably lose as well to be honest.
However, to write off his case is too early.
The cases I have provided are actually as balanced as I could find. Not many people have been able to object to a TUPE after the fact.
If there are many cases which prove me wrong, then please find one and highlight it as I would be interested to read it and I will hold my hands up.

Just look at my first example of the woman who was forced to transfer, after recieving documentation stating she was only going on a secondment to the new company.
What I think may go in the employees favour in this case is that they have not yet recieved a wage and they have been on holiday. But that is arguable.
Mitre have some faith with the cases ffs. I think Green will win this one as well as the EBT one. The players are chancing their arm.

Can you provide the law that states that documentation must be provided, or do you admit that there is none, and that it is only 'best practice' that you are quoting?
Also you have still not posted one other example of a case where someone has succesfully rejected a TUPE after the fact. Im not saying there are none, but they certainly dont seem to be as easy to find as you would suggest.

I know mitre is a wind up merchant, I was really just posting for those rangers fans who want to understand what is going on.
Saw browns speech at ibrox. Seems the going rate for the club is £25m or to be more precise the amount ticketus are owed.

I actually stumbled upon the notification stuff earlier, but was counting on you not looking into it so I could get away with it!
To be fair though, have you looked into what a failure to notify results in? It is not a nullification of the TUPE, but a financial award to the affected employee.
Oh and I take it you still havent found a case that backs up your claim yet?
