One thing looks certain - they haven't got anything on him up to now.

If he doesn't get convicted then he's ok I guess.

Looks like it.

I don't know mic about the Italian legal system, other than it's supposed to be mighty slow, so even if he was to lose the case dosent he get the right to appeal?

That would drag on, and the FA have said in ten days they will have their outcome

Obviously we are letting our inbuilt Leeds United paranoia colour our judgement of the FLs decision..........

I mean, All takeovers of Football Clubs take as long as this for the FL to make a decision.....Don't They ??

According to his lawyer it's a one day case. However the legal system there is in three stages. If they find him guilty he can appeal and it goes to the next stage. Then it can go to a third stage if required.

It might be different for tax cases like this but my guess is that his lawyer is saying one day because he expects him to get off. If he does the tax man could appeal and it goes to the next stage anyway.

It could be interesting if he gets off and there us an appeal lodged.

I found this from the Guardian...........
"Cellino is in court in Sardinia on Tuesday regarding non-payment of import duty on a yacht and is facing a €1.165m fine if found guilty. The Italian has been under investigation by the governing body since the announcement of his proposed takeover through his holding company Eleonora Sports, with the League investigating whether he passes their "fit and proper persons" test.

That prohibits people with unspent convictions for dishonesty offences from being directors, 30% owners or from exercising control over one of its clubs."

The last sentence seems to apply, but it's strange the FL allow clubs to accept monies to pay the monthly outgoings and help keep a club afloat thereby ensuring that they continue to profit from the club in question.

Even if Cellino is found guilty, it's Eleonora Sports that hold the majority shares, so what has the FL got on'em...................absolutely nothing.

They're dragging it out for a reason, personally I think someone is hoping Cellino loses patience and walks away, can't see it happening.

That Birmingham fella who got jail, what's his name, one tone tung or something; he's in jail for convictions, so, how can the FL take the ownership away from him, they can't.

How can the FL refuse Eleonora Sports cos Cellino got a conviction (if he does), they can't, but maybe they can stipulate Cellino can't be part of the ownership or staff at LUFC cos of his conviction, which will probably go to appeal or he gets off.

Should either of the latter happen and the FL still try to put it off then a lot of people will turn against Harvey and legal action could/will be on cards.................media will have a field day with that one.

Fat lot of good that will do, he'll still run things his way, from the shadows, and the FL will be powerless unless they have ground breaking evidence.

This is exactly why someone would give themselves the chance to see the outcome if a trial before making a decision that they cannot later change.

If we take our Leeds glasses off for a second, this decision actually makes sense - however frustrating for us as fans.

If the fit and proper assessment is to hold any validity, then if a prospective owner has an upcoming court appearance for tax evasion/corruption, then better to let it run it's course and see what the decision is. If he's acquitted then sanction the takeover, if convicted then you don't. Makes sense really.

Had the court case been another 6 months away i'd have been annoyed - but 10 days, it just makes sense to wait.

Be pretty stupid to pass this guy for being fit and proper, then 10 days later see him convicted for being a shyster. The press would annihilate the FL for that - and they know it.

But it doesn't mention that in the statement does it? They say that they are awaiting further information from Cellino and GFH. No mention of the impending court case and waiting for that outcome.

Stoopo ........... I've read the statement and I agree to an extent.

Personally i think that without directly linking the case, they're playing for time, so they can be aware of the outcome. Waiting for further information is a smokescreen i'm guessing. But then who knows?

I understand the need for clarity on the outstanding court case. Would seem sensible.

My only observation would be that the authorities haven't demonstrated as much due care and attention in the past so why now? Equally, would we see as much due diligence in the future?

If the case isn't settled next week and given the Italian's penchant for drawn out litigation it would suggest that it won't be, will the FL delay matters further?

It's a here and now situation. English Law is about innocent until proven guilty. Someone somewhere has to draw a line in the sand and get on with it.

Extra, no malice intended,

But that's just 1 fans opinion, when Cellino was in jail other fans stood outside the jail chanting his name.

He has for and against fans just like any owner or manager of a football club.

Irrespective of what some may think of him, Cellino looks like a person who's prepared to fight for what he wants and/or what he believes.

Quicker he takes over the quicker the dust settles and we can get on with rebuilding our team and club.

I can see your point, and it's a valid one, but by putting this off, then disguising it shows they're not doing the job properly, but hoping something happens at Cellinos court case that enables them to say no.

This would mean that up to now they have nothing on Cellino....................so the witch hunt has been going for a while.

Some people call that deceit or corruption, exactly the same thing that some say about Cellino.

They have said they re awaiting extra info from Cellino.

As far as I see it they are saying that they are awaiting Cellino to notify them of the result of his up coming court case.

It is cellinos responsibility to update the fl not the Italian court systems responsibility.

People are always looking for an enemy of Leeds treating us badly but its not the case here, fl doing their job correctly in difficult circumstances that are entirely of gfh and cellinos making.

Cellino has 3 charges of unpaid tax in the pipeline. Two yachts and a 4 x 4. Plus a charge for embezzlement.

If he were passed now, I can imagine there being a hell of a mess to sort out should he be found guilty of the first of those charges next week.

Why anyone would want a crook like Cellino involved with LUFC beats me.

His arrest warrant:

"He has marked criminal tendencies and is capable of using every kind of deception to achieve his ends."
