The only other thing is that even if he was 16 it would still be against the law and others have fallen foul of it even with that kind of age difference. I suppose you can't really put a sliding scale on the age difference when 1 party is that young, maybe it would be reflected in the sentence but it would still be a s3x offence on your file.

I can't really comment on the last two paragraphs and maybe he is a scapegoat. But the suggestion that she "didn't look underage" and "knew what she was doing" is irrelevant: she was underage. The former might help him if he didn't know but I don't think that was the case, was it?
