The Y Word:Update

Interesting

http://news.sky.com/story/1149949/y id-army-chant-spurs-fans-face-arrest (remove the space)

Motivated by hate, or out of affection it shouldn't be sung in my opinion

"We are going to go up to people first, engage firstly and try to explain to them what it means.

"Hopefully people will take that warning and desist from using the Y word.

"Anyone who continues to use it or fails to take on our advice may be subject to arrest."

I hope our fans see sense.

"Secondly, the police then have to prove that the fan arrested has chanted something in hate and is offensive towards the complainant. They have to establish a connection in order to say that fan has broken the law."

I'm sure Plod can just an "incitement / likely to incite" argument for such arrests.

They could arrest you would they have enough to charge you?

Section 3 Football Offences Act 1991

To prove this offence, the prosecution has to show that the chanting, which means the repeated uttering of words or sounds, was threatening, abusive or insulting to another person because of that person's colour, race, nationality (including citizenship) or ethnic or national origin.

Oh I think the Guardianistas in Plod and the CPS would find the "abusive or insulting" part good enough to try a prosecution.

Yes but there has to be a complainant. The point I was trying to make was monitoring and warning fans is a waste of time and they should, by the letter of the law, only be getting involved if somebody makes a complaint and is willing to pursue the matter themselves.

Then they have to prove that someone chanting Y Army is actually an offence or insult to said complainant. They would have to prove that is was directed towards complainant and the person charged actually chanted alleged words.
