Yes, a hypothetical.
Not a random one, he either has it upheld or it gets overturned. There is a chance he will.
Will you automatically say he is innocent?
If you are to be consistent you'd have to I suppose.

It was later proved the police had acted outside the law in both cases.

Fair point but it does prove that a conviction isn't necessarily sound and there does seem to be at least some areas of doubt in this case.
