Chelsea would likely need to pay the full fee, legally. Which would be worth considering.
Anything less and we should enforce the contractual agreement, because he has big wages.

There's a break clause in all these sorts of deals. It will have been agreed at the start. If they pay the fee they can get out of the arrangement.
Regarding the OP, I've taken a look at the rumours in the UK press and it seems like they are speculative. Can't see anyone claiming Chelsea sources are actively considering paying the penalty clause to avoid buying Sancho - only alluding to its existence and suggesting it's possible.

I’d rather have a crocked Mount around Carrington - a genuine model pro whose body is failing him through no fault of his own - than Sancho, who seems like a bit of a cancer in respect to the kind of environment, culture and personality we need. Plus Sancho clearly isn’t worth the baggage from a footballing perspective.

Apparently these exit clauses are written into most of these types of deals I was just reading. It's just 99.9% of the time the buying club doesn't change their mind so you don't hear about it.
If we get £8m and then can get £20m from Dortmund we are no worse off.
