I don't think you get to say what your intentions were, you either had illegal images or you didn't

It's like that guy who went home with a girl from a club who turned out to be 15, just because the club was 21+ only and he assumed she must be 15 doesn't mean he didn't break the law
----------------------------------------------------------------------
Going home with an underage girl is a different world from having images on a device. It's a statutory offence where you are guilty because it happened, no ifs or buts. However, you can't go home with a girl accidentally, but you can have images on a device accidentally.

A defence exists if he did not intentionally possess the material and upon discovering that you were in possession of such material, ceased to possess it, for example by deleting it. He can also argue that he did not have possession of the material if he did not actually download the material, but instead only viewed it.

That happened to someone I knew years ago.

He was the DJ and was found not guilty
----------------------------------------------------------------------
Perhaps he wasn't much older than the victim? There must be some detail or circumstance there.

It's more because I know Whatsapp stores images in a folder in your phone files even if you don't choose to have them automatically download to your gallery.

I'm guessing that's not actually the case here but would be interested in the legality if you genuinely didn't know Whatsapp does that, and had those images in your phone files solely because someone sent them to you without your consent.

----------------------------------------------------------------------
A person that deals with so many images and very active on WhatsApp would be very unlikely not to know how WhatsApp operates. Any reasonable person would know that Whatsapp does that, so I'd say that argument would have no legs IMO.

If they're on his phone he was in possession of them

Ignorance of the law does not get you off, nor does "I said nothing illegal" or "she said she was 16"

Agreed, but if he deleted them immediately and asked that they never be sent again, then he has a defence or reasons to seek a lenient sentence.

so if someone sent me photos of children, I could still get done even if I delete them immediately and ask not to be sent that stuff?

That doesn’t sound right

No. What I'm saying is if you do that then you have a defence.

39 police officers injured and 27 hospitalised last night in Southport.

I say again, can anyone imagine the absolute meltdown in the media today if anything *remotely* close to that - I mean even 10% of that - had happened at any single one of the literally scores of marches for peace in Gaza?

You have the power to block people on WhatsApp, seems a lame excuse to say they kept sending images

He said "nothing illegal"

I wonder why the police went into Southport and not Leeds? The police moderate their language and actions when dealing with protests involving minorities as they're terrified of being branded racists, they don't give a feck when they're white.

Why is it when white people protest and riot they're far right and yet if Muslims and minorities do it extremism is never brought up?

It’s dodgy ground, but I suspect there’s probably a bit more to it than this.

Is failure to report it to the police an issue as well?

Police did attend the Leeds riots and were one part of the reason it started but were outnumbered and retreated. They didn't have the resources to handle something that started suddenly.

The reason there was a heavier police presence in Southport is that there had been a huge incidence the day before, misinformation had led to threats, there was a vigil and likely worries from a big crowd descending on an area, copy cat attacks or those looking for revenge and the EDL lot had turned up who have a reputation for rioting.

It really isn't that complicated unless you are trying to search for some conspiracy to help with your own prejudices.

Claptard hasn't got a clue what he's on about for a change.

https://www.google.com/amp/s/amp.theguardian.com/uk-news/article/2024/jul/28/leeds-riots-harehills-disorder-muslim-men-children-care

"Nadsy Qurban bent his neck to show how the crown of his head was covered in a number of burns, each the size of coins. “The smell was like I’m burning some goat or something, like I’m cooking some goat. That’s how bad it was,” he said.

Needless to say, it hurt. But a week on, the burns he gained while putting out fires during unrest in the Harehills area of Leeds are starting to heal.

He was one of more than a dozen people, mostly Muslim men, who stepped in to de-escalate tensions on 18 July, when disorder was triggered by police and social services taking children from a Roma family into care"

Well there you go then. You've answered your own question.

Riot was started by police stepping into a social worker situation. The police felt like they were escalating tensions by showing a heavy presence. You've answered your own question.

Kids got removed by social services/police.

I can tell you from experience that is a last resort action and there must have serious concern for the kids welfare.
