I haven't gone through the whole thread, but all you need is on the link below. As has probably been said already - you just feel like you're in an alternative universe when you read about Donald Findlay cross examining Walter and Ally in a court of law

James Doleman @jamesdoleman
Findlay asks Smith if a football club's wage structure includes "bonus" for success on the field
He replies yes, for players and management
So they admit they cheated
Timmy - let's not over egg the pudding here, mate - I had a bonus scheme during most of my 38 year management career, and I never cheated

I don't quite get why they are examining the guys on the fitba side and asking fitba related questions
----------------------------------------------------------------------
Curly....I sometimes kid on that I'm obsessed but I'm not really...so I'm not really 100% what this trial is actually about (happy if someone wants to enlighten me).
But I can't for the life of me understand the relevance of any of this testimony. I'm sure that Findlay in particular knows what he is doing but I'm astonished that the judge is allowing any of this. It looks like circumstantial twaddle to me.

Didn't MEAN to sound so defensive.....
BTW...I'm in the US at the moment and an ad just popped up for a product that gives you relief from clenching and grinding. No idea what it was but I'll pass the number on it if comes up again. America...what a country

It does seem a really odd line of questioning to go down. Sure I read they reckon it could last up to 12 weeks-how the fluck are they going to spin it out for that long?!?

Silver...what is that actually a defence against (I'm not up to date with this trial).
Are these even defence witnesses?
Silver-it's more about him lying and acting fraudulently about the funds available rather than how they died....

I'm thinking (for what it's worth and that's not a lot these days 🙁) that Finlay is setting out the scenario that the club was already in dire straits with the bank about to call it in, the two tax cases and high unsustainable costs which meant that it was irrelevant as to what Whyte did as it wounding have changed anything.
Also the likes of Smith and McCoist were responsible in some way toward the continuation of taking on debt and one had fiduciary duties which he will say he failed in.
Added to that there is already the acknowledgment that the club knew what but we as doing in continuing to pursue players it couldn't afford and that dependence upon Europe was a massive gamble. A gamble too far.
Hence, what else could Whyte do but try and rescue the club by whatever means possible and it isn't uncommon to depend upon financing against upcoming season tickets. Ergo, Whyte acted in the onky way he could and that the club and its officers already had the club on the road to ruin before he came on board.
My thoughts anyway but I don't profess to be a legal beagle.
