What should be a higher authority in Poland? Polish law or EU law.

So at what point do you think the UN or EU should intervene in a individuals countries issues? There's has to be some sort of collective 'policing' of individual countries or every country would have a Kim jong at their helm eventually.

Yes 90% want to remain, but probably not for the reason of these spats.

77% voted to join the EU in 2003.

That means they voted for the legal situation they are in, if you want to go down the route of "domestic law should trump international law" then that's a massive can of worms with some pretty serious implications.

The fact of this scenario are clear. They overwhelmingly voted to join, they have benefitted enormously for doing so, and their population overwhelmingly wants to remain in, despite knowing that EU law takes precedence.

It's a non argument.

The Polish Government have a decision to make.
Lose out on the €150+ billion they have in covid record and development funds, or, push ahead with their politically appointed judiciary and force a vote on polecat which they lose.

The Commission begun infringement proceedings against Poland and Hungary some time ago.

Poland brought in legislation which meant judges were subject to political controls. Undermining their independence, a core principle of a functioning democracy.

Whatever your opinion of the EU, Poland signed up to the fundamental principles of EU membership, and has been found to have breached them.

As an aside Poland & Hungary also are subject to EU legal action as some (Polish) regions set up LGBT free zones. And "On 23 June 2021, Hungary published a law that lays down a number of restrictive and discriminatory measures."

You are like the safety of a cuddly bear with your replies and links. 🐻

I'm far from arguing the legalities of the issue. But there is some important issue with the authority of the EU over individual countries. Whether the laws are a good thing or bad is neither here nor there. As countries bind ever closer within the EU there will always be some trepidation with losing 'sovereignty'. Or at least the perception of it.

Unfortunately its a consequence of the aforementioned countries government's authoritarianism.

Non-discrimination & equality are core principles of the EU, and both countries would have been fully aware they breached the EU's Charter of Fundamental Rights when they implemented said policies.

A bit like being a member of a golf club and, a member dropping their trousers and sh 1tting on the 18th green. The club may not be best pleased

Think about it form a housing association or shared ownership of a block of flats

Just because you live on the ground floor doesn't mean you don't have to pay equal share for maintenance of the lift and just because it's shared ownership doesn't mean you get to take a dump in the plantplot

And when you sell up and move out you don't get to take out what you put into the service charge nor do you get a say in what they do with the property (even if it effects you because you love across the road)

How is "Poland's top court has rejected the principle of the primacy of EU law over national legislation in certain judicial matters" and "The Constitutional Tribunal said some EU treaty articles were incompatible with Poland's constitution" an attack on Polish judges? It is (a justified) attack on EU power grabs. Polish constitution rules in Poland, as should be the case in every other country.

I know exactly what this is, it's activist judges using the laws of a foreign entity to impose their will on a sovereign country, overriding their national constitution. That is treason. National constitution beats all and that should be the case in every country.

Ever heard of something called self determination?

If a country wilfully enters a treaty or agreement where regional law supersedes local laws and the constitution then they enter a treaty or agreement where regional law supersedes local laws and the constitution.

Simple as that and happens a lot actually so don't say it like its some golden rule written in stone. Any country that isn't willing to follow EU law should leave pronto. The EU should fack them off anyway along with anyone else that doesn't want to play ball.
